Launch Prize Draw Series – $5,000, $10,000 and $20,000 Cash Prizes
IMPORTANT: These Prize Draw Terms and Conditions are specific to the Launch Prize Draw Series described below and should be read in conjunction with the What’s Your Opinion Website Terms and Conditions of Use (General Terms), which govern your use of the Website, membership, Points system and Prize Draw framework generally. To the extent of any inconsistency, these Prize Draw Terms and Conditions prevail over the General Terms in respect of this promotion.

TERMS AND CONDITIONS
1. Promoter
(a) The promoter of this Prize Draw is Real Demographics & Statistics Australia Pty Ltd (ACN 670 449 117) trading as What’s Your Opinion, of 435 Nepean Highway, Frankston 3199 Victoria (Promoter).
2. Definitions
(a) In these Prize Draw Terms and Conditions, unless the context otherwise requires:
Draw Date means the date on which the winner of the relevant Prize Draw is selected, as specified in the Schedule.
Entry means a valid entry into a Prize Draw in accordance with clause 5.
General Terms means the What’s Your Opinion Website Terms and Conditions of Use, as amended from time to time.
Member has the meaning given in the General Terms.
Points has the meaning given in the General Terms.
Prize means the cash prize specified for the relevant draw in the Schedule.
Promotional Period means the period during which Entries may be submitted, as specified in the Schedule.
Website means the What’s Your Opinion website located at https://whatsyouropinion.com.au/.
3. Eligibility
(a) Entry into each Prize Draw is open to individuals who, at the time of entry and at the time of the relevant draw:
(i) are aged 18 years or over;
(ii) are permanent residents of Australia;
(iii) hold an active membership on the Website at the membership tier specified for the relevant draw in the Schedule (for Points-based entry) or who submit a valid entry via the Free Alternative Method of Entry (clause 5.4);
(iv) have a valid and active Account on the Website (for Points-based entry); and
(v) are not employees, directors, officers or contractors of the Promoter (or their immediate family members), or any entity involved in the administration of this Prize Draw.
(b) The Promoter reserves the right to verify the eligibility of any entrant and to disqualify any entrant who does not meet the eligibility requirements or who the Promoter reasonably believes has breached these Prize Draw Terms and Conditions.
(c) Participation in this Prize Draw is deemed acceptance of these Prize Draw Terms and Conditions and the General Terms.
4. Promotional Period
(a) Each Prize Draw opens and closes in accordance with the Promotional Period specified in the Schedule. Entries received outside the Promotional Period will not be accepted.
(b) The Promoter reserves the right to extend, shorten or modify the Promotional Period at its discretion, provided reasonable notice is given to Members via the Website.
5. How to Enter
Points-Based Entry
(a) To enter via the Points system, eligible Members must redeem 500 Points per Entry through the Website during the Promotional Period. Each redemption of 500 Points constitutes one Entry.
(b) Points are earned by Members through completing surveys and other qualifying activities on the Website in accordance with the General Terms. Points cannot be purchased. For the avoidance of doubt, no payment is required to earn Points – Points are earned through participation in surveys and activities available to all Members.
(c) Multiple Entries are permitted, subject to any maximum entry cap specified in the Schedule. Each Entry must be submitted separately and requires a separate redemption of 500 Points.
Free Alternative Method of Entry (AMOE)
(d) No purchase or payment is necessary to enter this Prize Draw. As an alternative to Points-based entry, any eligible person (including non-Members) may obtain one (1) free Entry per Prize Draw by sending a stamped, self-addressed envelope (minimum DL size) to the following address:

The envelope must include the entrant’s full name, email address, date of birth, state or territory of residence, and the specific Prize Draw being entered. Postal entries must be received by the Promoter no later than 5:00 PM AEST on the business day immediately prior to the Draw Date. Postal entries received after this time will not be accepted.
(e) Free alternative entries will be included in the same draw pool as Points-based entries. Each free alternative entry carries the same chance of winning as a single Points-based entry.
General Entry Conditions
(f) The Promoter is not responsible for Entries that are lost, late, misdirected, illegible or incomplete, whether as a result of technical, postal or other failure.
(g) The Promoter reserves the right to reject or invalidate any Entry that it reasonably considers to have been made in breach of these Prize Draw Terms and Conditions, including (without limitation) automated or bot-generated entries, duplicate entries from the same individual using multiple accounts, or entries that manipulate or exploit the Points system.
6. Prize
(a) The Prize for each draw is the cash amount specified in the Schedule. The total prize pool for the Launch Prize Draw Series is $35,000 (comprising $5,000, $10,000 and $20,000 across three separate draws).
(b) Prizes are awarded in Australian dollars and will be paid by electronic funds transfer to a nominated Australian bank account within 30 days of the winner providing valid identification and bank account details.
(c) Only one Prize is available per draw. Prizes are not transferable or exchangeable and cannot be redeemed for goods or services. Cash prizes cannot be substituted for any other form of prize, unless the Promoter is unable to provide the stated Prize for reasons beyond its reasonable control, in which case the Promoter may substitute a prize of equal or greater value.
(d) The Promoter accepts no responsibility for any tax implications that may arise from winning a Prize. Winners are advised to seek independent financial and taxation advice.
7. Winner Selection
(a) On the Draw Date and at the time specified in the Schedule, the winner of each Prize Draw will be selected by computerised random number generator from all valid Entries received during the Promotional Period.
(b) The draw will be conducted by or on behalf of the Promoter at the Promoter’s registered office.
(c) The random selection process is final. No correspondence will be entered into regarding the draw process, except as required by law.
8. Winner Notification and Claiming
(a) The winner will be notified by telephone call to the number registered on their Account (or provided in their postal entry) within 48 hours of the draw. A follow-up notification will be sent by email.
(b) The winner must respond to the notification and complete any required verification within 14 days of the initial notification (Claim Period). Verification may include provision of:
(i) valid government-issued photo identification;
(ii) proof of age and Australian residency;
(iii) proof of active membership at the relevant tier (for Points-based entries); and
(iv) nominated Australian bank account details for payment.
(c) If the winner cannot be contacted or fails to claim the Prize within the Claim Period, the Promoter reserves the right to conduct a redraw under the same conditions as the original draw. The redraw winner will have 14 days from notification to claim the Prize.
(d) The Promoter may publish the winner’s name, state or territory and membership tier on the Website and in promotional materials, unless the winner requests otherwise in writing within 7 days of being notified.
9. Trade Promotion Compliance
(a) This Prize Draw is a trade promotion conducted for the purpose of promoting the Promoter’s survey platform and membership services. Entry into the Prize Draw is free – no purchase or payment is required to enter. Points are earned through participation in surveys and activities on the Website and are promotional in nature only, with no monetary value.
(b) This Prize Draw has been structured to comply with applicable Commonwealth and state/territory trade promotion legislation, including:
(i) the Interactive Gambling Act 2001 (Cth), section 8BB (trade promotion gambling service exclusion);
(ii) the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law); and
(iii) applicable state and territory trade promotion legislation in each jurisdiction in which the promotion is conducted.
(c) Because entry into this Prize Draw does not require any form of payment, purchase or wager, and Points are earned through free participation in surveys and activities (not purchased), this promotion does not constitute a lottery, raffle or gambling service and does not attract trade promotion lottery permit requirements under applicable state or territory legislation.
(d) The free alternative method of entry (clause 5.4) is provided to ensure that no purchase or payment is a prerequisite to entry, in accordance with applicable trade promotion requirements.
10. Privacy
(a) The Promoter collects personal information from entrants for the purpose of conducting the Prize Draw, including verifying eligibility, notifying winners, fulfilling prizes and (where required by law) publishing winner details.
(b) Personal information will be handled in accordance with the Promoter’s Privacy Policy, available on the Website, and the Australian Privacy Principles under the Privacy Act 1988 (Cth).
(c) By entering this Prize Draw, you consent to the collection, use and disclosure of your personal information for the purposes described in this clause and the Privacy Policy.
(d) Personal information collected for the purpose of this Prize Draw will not be used for unrelated marketing purposes without your separate consent.
11. Limitation of Liability
(a) To the maximum extent permitted by law, the Promoter and its officers, directors, employees, agents and contractors are not liable for any loss, damage, injury, cost or expense (whether direct, indirect, special or consequential) arising out of or in connection with:
(i) participation in the Prize Draw;
(ii) any technical, telecommunications or other failure affecting entry submission or the draw process;
(iii) any act or omission of a third party;
(iv) the receipt, use or enjoyment of any Prize; or
(v) any tax liability incurred by a winner.
(b) Nothing in these Prize Draw Terms and Conditions excludes, restricts or modifies any right, remedy, guarantee or condition implied or imposed by any legislation (including the Australian Consumer Law) which cannot lawfully be excluded, restricted or modified.
12. General Conditions
(a) The Promoter reserves the right to cancel, suspend, modify or extend this Prize Draw at any time if it considers it necessary or desirable to do so (including where events beyond its reasonable control prevent the Prize Draw from being conducted as planned), subject to any written directions from a regulatory authority.
(b)The Promoter may, in its sole discretion, disqualify any individual who tampers with or interferes with the entry process or the operation of the Prize Draw, acts in a disruptive manner, acts in violation of these Prize Draw Terms and Conditions, or acts with the intent of causing annoyance, abuse or harassment.
(c) Failure by the Promoter to enforce any of these Prize Draw Terms and Conditions in any instance does not constitute a waiver of the Promoter’s right to do so in the future.
(d) If any provision of these Prize Draw Terms and Conditions is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
(e) These Prize Draw Terms and Conditions are governed by the laws of Victoria, Australia. Any dispute arising out of or in connection with this Prize Draw is subject to the exclusive jurisdiction of the courts of Victoria.
